The Balochistan Environmental Protection Bill, 2012 has been passed by the provincial assembly of Balochistan on 24th December, 2012 and assented to by the Governor, Balochistan on 9th January, 2012 and published as the Balochistan Environmental Protection Act, 2012 on 15th January, 2013.
The Balochistan Environmental Protection Act, 2012 provides the protection, conservation, rehabilitation and improvement of the environment, monitoring, prevention and control of pollution, and promotion of sustainable development.
- Section 14 – Prohibition of certain discharges or emissions and potential harmful items or materials
Subject to the provisions of this Act, rules and regulations, no person shall discharge or emit or allow the discharge or emission of any effluent or wastes or air pollutant or noise, in an amount, concentration or level or is likely to cause, a significant adverse effect on the environment or human health which is in excess of Environmental Quality Standards; or, where applicable, the standards established under sub clause (ii) clause (f) of section (6).
- Section 15 – Initial environmental examination and environmental impact assessment
No proponent of a project of public and private sector shall commence construction or operation unless he has filed an initial environmental examination with the Government Agency designated by Balochistan Environmental Protection Agency, as the case may be or, where the project is likely to cause an adverse environmental effects, an environmental impact assessment, and has obtained from the Government Agency approval in respect thereof.
- Section 16 – Prohibition of import of hazardous waste
No person shall import hazardous waste into Balochistan and its jurisdiction limits.
- Section 17 – Handling of hazardous substances
Subject to the provisions of this Act, no person shall generate, collect, consign, transport, treat, dispose of, store, handle or import any hazardous substance except having the licence as per sub-sections of Section 17.
- Section 21 – Regulation of motor vehicles
Subject to the provisions of this Act, and the rules and regulations, no person shall operate a motor vehicle from which air pollutants or noise are being emitted in an amount, concentration or level which is in excess of the Environmental Quality Standards or where applicable the standards established under clause (e) sub-section (I) of section 6.
