The Khyber Pakhtunkhwa Environmental Protection Act, 2014 provides the legal framework for environmental protection, pollution control, environmental assessment and sustainable development in the Province of Khyber Pakhtunkhwa.
The Act is known as Khyber Pakhtunkhwa Act No. XXXVIII of 2014 and applies throughout the Province of Khyber Pakhtunkhwa.
Key Provisions
Section 11 – Prohibition of Certain Discharge or Emissions
Provides controls on the discharge or emission of effluents, wastes, air pollutants, noise and other pollutants that may cause adverse environmental effects.
Section 12 – Strategic Environmental Assessment
Provides for Strategic Environmental Assessment (SEA) of relevant policies, plans and programmes to consider environmental impacts before they are finalized.
Section 13 – IEE and EIA
Requires proponents of projects to submit an Initial Environmental Examination (IEE) or Environmental Impact Assessment (EIA), as applicable, and obtain environmental approval before commencing construction or operation.
Section 14 – Prohibition of Import of Hazardous Waste
Prohibits the import of hazardous waste into Khyber Pakhtunkhwa.
Section 15 – Handling of Hazardous Substances
Regulates the generation, collection, transportation, treatment, storage, import and handling of hazardous substances and requires compliance with applicable licensing requirements.
Section 16 – Regulation of Motor Vehicles
Provides for control of air pollutants and noise from motor vehicles and allows the Agency to require pollution-control measures, specified fuels, maintenance or testing.
Section 17 – Environmental Protection Order
Allows the Environmental Protection Agency to issue an Environmental Protection Order (EPO) where pollution or other activities are likely to cause or are causing adverse environmental effects or violations of environmental standards.
Section 18 – Penalties
Provides penalties for contraventions of specified provisions of the Act, including continuing violations.
